AssociationWire terms and conditions
GENERAL These conditions of use govern your purchase and use of editorial content (‘Content’) from AssociationWire ('AssociationWire'). AssociationWire is owned and operated by FR Purnell and JR Knights trading as FlapJack Custom Publishing ABN 57 287 231 951 ('FlapJack'). In addition to these conditions of use, you agree when using the AssociationWire service to be bound by any additional terms, conditions, notices, and disclaimers which appear on www.associationwire.com.au (‘Site’). The terms of the Privacy Policy will apply to the use of your personal information by FlapJack. FlapJack may alter these conditions of use from time to time. Any such changes will be notified on this page and your continued use of the AssociationWire following those changes indicates your acceptance of those changes.
REGISTRATION All information you provide to FlapJack must be accurate, complete and up-to-date. It is your responsibility to inform FlapJack of any changes to this information. AssociationWire is a commercial content syndication service providing access to news and feature content generated by FlapJack and its associates. In order to access content from AssociationWire, you must register on the Site. Once you have registered on the Site, you will receive a user name and password. It is your responsibility to ensure that they are kept confidential at all times. In addition, you are entirely responsible for all activities that occur under your user name and password, including unauthorised use of your credit card.
Please read our standard terms and conditions for information about use of content, copyright,and prohibited conduct. In addition, the following terms and conditions apply specifically for the 10 day free trial: Only one free trial period will be provided per organisation. You may order up to three news stories and two features during the trial period. The 10 day trial period begins on the day you submit your registration. By signing up for the 10 day free trial, you are providing your consent to receive the AssociationWire weekly e-newsletter and other marketing communications from us from time to time. If you wish to unsubscribe at any time, please email privacy@associationwire.com.au.
PURCHASE AND USE OF CONTENT/COPYRIGHT Browsing of headlines and abstracts of articles on the Site is free. However, fees are charged to obtain full versions of content for reproduction on your website or in your publication. These fees and the uses which may be made of the content you purchase are set out below. FlapJack may alter the fees charged for content, or add new fees, at any time. Any such change will be notified on the Site. For our pricing structure visit www.assocationwire.com.au/pricing. By ordering and downloading content from AssociationWire, you agree that you are obliged to pay FlapJack for the use of that content. Unless otherwise agreed in writing, content may be used on a website and in a publication registered to your organisation’s name and no content may be resold or distributed to a third party. If the content is intended for any use than editorial publication (such as advertising or book publishing), you must seek prior written permission from FlapJack. While you may make small changes to the content to alter to house style or edit for length, any changes which could materially change the meaning of the content must be approved by FlapJack. To seek this approval, please email editor@associationwire.com.au, and we will endeavour to respond within 24 hours. All content displayed on the Site and distributed by AssociationWire is protected by copyright. You are only given a non-exclusive, limited licence to use the content you purchase, as set out above, and you agree that you will only use the content in accordance with these terms and conditions. Except for the limited rights to use Images and other content as set out in these conditions of use, you obtain no other rights in the content you purchase. Wherever content is reproduced, it must carry a small credit/copyright notice to Association Wire. DISCLAIMER AND LIABILITY All content on the Site and distributed by AssociationWire is provided on an 'as is' basis. To the extent permitted by law, FlapJack makes no representations or warranties in relation to the Sites, or the Images and other content on the Sites. In particular, FlapJack makes no representations or warranties that: (a) the content will be complete, accurate or timely; (b) the Site, or any of the content on the Site, will be available at all times or that access to the Site will be free of delays or interruptions; (c) the content is suitable for any particular purpose; (d) the content can be used in a commercial context without written permission; and e) the Site and content will be free from viruses and will not cause any equipment or software failure. PROHIBITED CONDUCT You represent and warrant that your use of the Site, and of the content purchased from the Site or from AssociationWire, will not be for any purpose that is unlawful or prohibited by these conditions of use or any other conditions, notices or disclaimers appearing on the Site. In addition, you agree to not use the content to defame, abuse, harass, stalk, threaten or otherwise offend others or to use the content in connection with any material that is obscene or pornographic, denigrates a particular group of people or that is otherwise unlawful or likely to be offensive to the general public. You agree to indemnify and hold harmless FlapJack and its related bodies corporate from any claims, losses, damages or expenses that it may sustain or incur as a result of your breach of these conditions of use or any law.
TERMINATION If you do not agree with these conditions of use or any modifications to them, your only recourse is to immediately discontinue your use of the AssociationWire service. We respect the privacy of our clients, business contacts and suppliers. We understand that the privacy of your information is important to you. This privacy policy outlines the types of personal information that we collect and how it is used. It also explains your rights in relation to that information. 1. Information collected about clients of AssociationWire We will ask you for personal information when you register with us to use an AssociationWire service. The information may include your name and your contact details, the identity and contact details of your employer and details of the products and services that you are interested in. This information is used to provide you with our service(s), to invoice you for your use of the services and to respond to any queries which you may have in relation to the services. At the time of collecting this personal information, we may also request other information about you to assist FlapJack in identifying which of our current and future products and services may be of interest to you. We may also use this information to improve the range of services available to you, by sending you information on our products and services. If you wish to opt-out of such communications, please email us at privacy@associationwire.com.au. We also collect personal information about you when you send us an email, in which case we collect your email address and whatever information you choose to include in the contents of the email. We use this information to respond to your email and to provide the services. We may also send site and service announcement updates to clients. You are not able to unsubscribe or opt-out of service announcements. We may also communicate with you in connection with the provision of services and issues relating to your account(s) with us via email, telephone or other methods. We may log your IP address and the use of your username and password. We will use this information to confirm your compliance with the terms of your agreement with us, to monitor your use of the website and for billing purposes.

Provision of information to third parties We do not, and will not, sell, share or rent personal information relating to our clients to any third party, except that (a) we may share information with our subsidiaries for similar uses to the uses outlined above; (b) we may provide information when required in order to respond to subpoenas, court orders or legal process; and (c) in the event of a sale of the AssociationWire business or of FlapJack, such information could be part of the business transferred.

Security of personal information We take reasonable steps to ensure the security of personal information held by us from such risks as loss or unauthorised access, destruction, use, modification or disclosure. Our IT systems are password protected and satisfy other industry standard security measures, and if personal information is held on paper files, it can only be accessed by authorised personnel.

5. Rights to personal information held by FlapJack Under the Privacy Act, you have a right to seek access to information we hold about you. You also have the right to ask us to correct information about you which is inaccurate, incomplete or out of date.
In the first instance, we will generally provide you with a summary of the information we hold about you. We will assume (unless you tell us otherwise) that your request relates to our current records about you. These current records will include personal information about you which is included in our computers, databases and in paper files, and which may be used by us on a day to day basis. To provide you with access to this personal information, we will ordinarily provide you with a print-out of the relevant personal information from our databases, or with photocopies of records which are held only on paper files. If personal information about you (for example, your name and address details) is duplicated across different databases, we will generally provide you with one print-out of this information, rather than multiple print-outs. We will not charge you for the cost of providing this type of access to these records. If you are of the view that personal information about you is not accurate, complete or up to date, please provide FlapJack with your request for correction, and we will update this information within 7 working days.
